Judicial Endorsement Committee. Did you know CASE is creating a Judicial Endorsement Committee whose mission will be to endorse and assist applicants for judicial positions to ensure the promotion of the most qualified and diverse individuals to the bench? The Committee will endorse candidates for judicial appointments who, in addition to demonstrating attributes of an excellent jurist, are responsive to the needs and concerns of their fellow CASE members. Hiring Above Minimum. As we last reported, CalHR has updated the Human Resources Manual. Section1707.Hiring Above Minimum (HAM) which reflects the elimination of the delegated authority to provide HAM rates on an individual basis. As part of these revisions, any current employee already in the classification as of October 1, 2024, was eligible for the authorized rate if they were currently below the rate specified.

CASE recently met with CalHR to discuss the details of these revisions as CASE is unable to negotiate the process by which the HAM rates are implemented and only became aware of the fact that receiving a HAM rate resets the employee’s anniversary date when we were contacted by members. The decision to voluntarily increase attorney pay for those at the bottom of the pay scales was made by CalHR without any consideration or input from CASE. Notice to CASE was provided after CalHR made their decision. It is extremely rare for the state to increase employee pay outside of negotiations.

CalHR shall provide that the number of months of qualifying service be proportionately reduced from 12 to the number of months that will permit the employee to receive approximately the same annual salary the employee would have received with a one-step increase.

For example, if an employee’s rate of pay was increased by 2.1% per Section 5, their anniversary date would be accelerated by 6 qualifying pay periods. If an employee’s rate of pay was increased by 5.6% per Section 5, they would retain the same anniversary date.

CalHR stated that departments have received information in order to implement the MSA acceleration although CASE has been informed that many departments have not actually accelerated the MSAs for qualifying attorneys. CASE requested that CalHR remind all departments of the need to accelerate the MSAs of applicable employees. Please contact info@calattorneys.org with any questions.
