CASE BOARD OF DIRECTORS’ UPDATE 

CASE Saves National Guard Member’s State Benefits. Departments are sometimes unfamiliar with the special personnel rules and processes that apply to Unit 2 professionals who also serve in the US military. This week, CASE was able to resolve a long-pending grievance filed on behalf of a member whose department mismanaged their leave credits, Merit Salary Adjustment, service credits, and retirement contributions. CASE’s successful resolution of the grievance restored the pay, benefits, and service credits owed to the servicemember. The grievance serves as a great reminder to contact CASE if you believe your department has violated your rights under the Unit 2 MOU. 

MOU Expiration Reminder. The current MOU expires tomorrow, but per Government Code 3517.8, CASE and the State are required to continue to give effect to the provisions of the expired MOU. This means the MOU’s rights, protections, and obligations continue to apply until either a successor agreement is reached or impasse, a legal term of art defined and decided by the California Public Employment Relations Board (PERB), is declared. BETTER KNOW YOUR MOU

Buying Time. While state-imposed, compulsory PLP days are over, some Unit 2 employees found value in a larger leave balance or the option of more time off. If you’d like more leave time, you can take advantage of Article 9.25 of the MOU which offers a Voluntary Leave Program (VPLP) to interested employees. Under the program, you can exchange a reduction in pay for 8, 16, or 24 additional hours of leave each month. Using VPLP doesn’t impact your benefits, nor does it cause a reduction in the accumulation of service credit for seniority or retirement calculations. A 240 hour accumulated VPLP credits cap and other requirements apply, so make sure to review Article 9.25 or contact CASE staff with any questions.
