CASE Filed An Unfair Labor Practice at PERB. In response to Governor Gavin Newsom’s Executive Order (EO) mandating that all agencies and departments subject to his authority implement hybrid telework policies with at least four in-person days per work week beginning July 1, 2025, CASE has filed an Unfair Practice Charge (UPC) with the Public Employment Relations Board (PERB) alleging that the Governor’s EO violated the Dills Act.  

CASE’s UPC alleges the following specific ways the Governor’s EO has violated the Dills Act: 

  1. Issued Executive Order N-22-25 on March 3, 2025, without first meeting and conferring with CASE in good faith regarding the terms and conditions of employment for Bargaining Unit 2 employees, specifically the number of telework days per week allowed, and the impact on Telework Stipends, prior to arriving at a determination of policy or course of action, as required by Government Code section 3517; 
  1. Issued Executive Order N-22-25 on March 3, 2025, without fully considering such presentations made by CASE on behalf of its members, prior to arriving at a determination of policy or course of action, as required by Government Code section 3517; 
  1. Unlawfully disregarded the requirements of the DGS Statewide Telework Policy, which expressly places the authority and responsibility on individual departments to establish a telework policy that is “specific to the department’s business needs”
  1. Unlawfully deprived CASE of its right to represent its members in their employment relations with the State on matters within the scope of representation, in violation of Government Code 3515.5; 
  1. Unlawfully deprived Bargaining Unit 2 employees of their right to be represented by CASE in their employment relations with the State on matters within the scope of representation, in violation of Government Code 3515; and 
  1. Unlawfully impaired CASE’s bargaining position and rights with respect to the Telework Program and Telework Stipends.  

To remedy these violations, CASE has requested that PERB issue an order instructing the State to immediately rescind the Governor’s EO, comply with the DGS Statewide Telework Policy, respect CASE’s 2022-25 Memorandum of Understanding, cease and desist from engaging in further violations of CASE’s and its members’ collective bargaining rights, award CASE with reasonable attorney’s fees and costs for vindication of CASE’s and its members’ rights should this matter persist, and to provide any other remedy PERB deems just and appropriate.

CASE’s Sponsored Legislation. CASE’s sponsored legislation, SB 605, which would seek to ensure competitive compensation for state attorneys and administrative law judges in State Bargaining Unit 2 by aligning their salaries with those of public sector attorneys across California, was held on the Senate Appropriations Committee’s Suspense File. This means that the bill is no longer moving forward this year. The difficult decisions made by the Appropriations Committees in both houses were informed by the state’s budget situation – the $12 billion deficit the state faces in the current year. 

CASE, together with our lobbying and communications teams, made every effort to advance this bill to provide CASE members with the compensation parity they deserve, and we are disappointed at this outcome, but we will continue to fight for better wages and working conditions for all CASE members at the bargaining table and in the legislature.
