Jurisdiction at PERB.  Last week the Governor signed AB 288.  This bill expands PERB’s jurisdiction to allow it to hear petitions from private sector employees under certain circumstances.  The main impact on CASE will be that PERB’s docket will be even more crowded.  While PERB has done a good job at resolving their large backlog over the last few years, this bill could reverse that trend.

The only substantive improvement for public employees is that PERB now has authority to issue a civil penalty against an employer in the amount of $1000 per employee, if it finds the employer engaged in a pattern and practice of committing unfair practices.  The money would go into PERB’s enforcement fund, and because the State is playing with house money, this likely will not be much of a deterrent on state agencies.
