CASE BOARD OF DIRECTORS’ UPDATE

CASE Fights for CUIAB Judges. Earlier this month, CASE negotiated a settlement with the California Unemployment Insurance Appeals Board (CUIAB) regarding the increasingly arduous caseloads imposed on the Board’s ALJs. The deal reduces ALJ caseloads from 31-34 cases per week to 28-31 cases per week and provides for retroactive decision days (DEC days) of 1/2 day for each quarter that ALJs have been handling 31-34 cases per week. The settlement also prevents caseload increases until July 2022. CASE will continue to vigilantly monitor CUIAB ALJ caseloads. Click here to read the settlement.

CALPERS CORNER

Regional Offices Reopen. CalPERS has resumed in-person services at its eight regional offices after closing them for two years due to COVID-19 public health concerns.  CalPERS officials ask that you schedule appointments using this three-step online process:

  1. Log in to myCalPERS.
  2. Select the Education tab.
  3. Select Appointments. You can choose to book an in-person appointment at one of the offices in Fresno, Glendale, Orange, Sacramento, San Bernardino, San Diego, San Jose, and Walnut Creek.  Video and phone appointments also are available.

Or you can schedule by calling 888-CalPERS (that’s 888-225-7377) during business hours, Monday through Friday from 8:00 a.m. to 5:00 p.m.

CASE ON THE CASE

Los Angeles, Oakland Parking Rate Increases. CASE recently received notice from the state that parking costs will increase this summer for lots adjacent to a couple of state buildings in Los Angeles and one in Oakland. The rates are set by the cities, “which may require state agencies to assist in the collection and remittance of municipal taxes,” according to a California Supreme Court ruling in City and County of San Francisco v. Regents of the University of California, 7.CAL.5th 536, 560 (2019).

In Los Angeles, the tax rate is 10% of the monthly and daily parking rate; in Oakland, the tax rate is 18.5%. In Los Angeles, the affected parking lots are the Ronald Reagan Building at 300 S. Spring Street, and the Van Nuys State Building, 6150 Van Nuys Blvd. In Oakland, the affected parking lot is at the Elihu Harris Building, 1515 Clay Street.

Effective July 1, 2022, employees renting parking in those facilities will be required to pay the imposed tax along with the space rental. The Office of Fleet and Asset Management will collect and remit the taxes. CASE is exploring ways to mitigate these increases, including continued or expanded telework and employer subsidies, among others.  Share your ideas with CASE by emailing case@calattorneys.org.
